(4) Article 19: 1. Everyone shall have the right to freedom of expression.. 2. The exercice of the rights provided for in Paragraph 2 of this article carries with its special duties and responsibilities. It may therefore be subject to certain restrictions, but these shall only be such as are provided by law.
(5) Article 21: 1. The right of peaceful assembly shall be recognized. 2. No restriction may be placed on the exercice of this right other than those imposed in conformity of the law.

Vietnam blogger community’s rebuttal to Statement 258
Considering that:
- "Patriotism is the sacred duty of the people of all nations. It is nothing abnormal if a man is provoked into having political perspectives and views that contradict with the State’s policies by patriotism. Nevertheless, such “patriotic” acts like the ones of Tran Ich Tac who has once called for foreign intervention in his country is in fact considered as “unpatriotic”, if not an act of treason" ( 1 )
- Article 29 of the Universal Declaration of Human Rights ( 2 ) clearly stated: "(1) Everyone has duties to the community in which alone the free and full development of his personality is possible.
In the exercise of his rights and freedoms, everyone shall be subject only to such limitations as are determined by law solely for the purpose of securing due recognition and respect for the rights and freedoms of others and of meeting the just requirements of morality, public order and the general welfare in a democratic society. These rights and freedoms may in no case be exercised contrary to the purposes and principles of the United Nations.”
- After the Universal Declaration of Human Rights, the United Nations adopted a number of International Covenants. Notably, on December 6th 1966, the UN General Assembly approved the International Covenant on Civil and Political Rights: The CP Covenant; the International Covenant on Economic, Social, and Cultural Rights: The Covenant ESC. In Articles18, 19, 20, that discuss the right to freedom of thought, conscience and religion, freedom of expression, freedom of association rights and peace, it is specified that these Articles are "subject only to such limitations as are prescribed by law and are necessary to protect public safety, order, health or morals or the fundamental rights and freedoms of others."
- Article 258 of the 1999 Penal Code of Vietnam, amended in 2009 clearly stated that only those who ABUSE the right to democratic freedoms to infringe upon the interests of the State, the legitimate rights and interests of organizations and/or citizens are subjected to the article. Therefore, it is not the aim of the article to restrict and remove freedom and democratic rights of the people as distorted in "Statement 258". This regulation is "necessary to protect public safety, order, health, morals and the fundamental rights and freedoms of other citizens"
Moreover, Article 258 of the Criminal Code was adopted by the National Assembly of the Socialist Republic of Vietnam - the highest authority of the people of Vietnam – an independent country with sovereignty and complete national autonomy as well as the legal status equal to any country in the world. The Article aims at important valueswhich form the basic legal framework to protect the community unity of the people of Vietnam along with cultural values, traditions, history, religion, ethics and most importantly, to protect the right of freedom and democracy of the organizations and/or citizens from being infringed by the implementation of the freedom and democracy of other organizations and individuals.
- Blogger Doan Trang - who initiated the “Statement 258”, has declared that the Statement was the first step to "review the whole political system of Vietnam." It can be clearly seen that the review of Article 258 of the Penal Code is actually paving the way for propaganda activities of the few people who impersonate the "Vietnam blogger network" to stir against the State of Vietnam, undermining national unity as well as traditional cultural and moral values. The picture of a group of a bloggers being happy upon their so-called "victory" when leaving the Embassy of the United States, Germany, Australia and Sweden after the submit of "Statement 258" has sowed shame and humiliation in the mind of each Vietnamese citizen, implying a national disgrace to the image of Tran Ich Tac, Le Chieu Thong.
Thus:
By this statement, the Blogger Community of Vietnam refute "Statement 258" of a minority, which opposed public and national interest and has impersonated the whole community to tarnish nation’s honor, humiliated Vietnamese people’s pride and smeared the “Lac Hong bloodstream”.
